In Kolden Holdings Ltd v (1) Rodette Commerce Ltd (2) Taplow Ventures Ltd - Lawtel 3.8.07 the Commercial Court on a summary assessment of costs, held that as the rates charged by the fee earners were above the guideline rates they were too high and would be reduced. The time spent on certain aspects of the case appeared to be wholly excessive and would be reduced. It held that as the hearing of the application took less than one day there was no need for three representatives of the solicitors to be present and, as leading and junior counsel were present, it was not necessary to have further counsel attend. There was only a small number of documents. The parties would produce an order bearing the sum total to be paid by the losing party, incorporating the court's ruling.
