The United States Army Corps of Engineers (Vicksburg District)(“Corps”) issued an April 25th public notice referencing an application for a Section 404 Clean Water Act Permit for the discharge of dredge and/or fill material into the waters of the United States in Hempstead County, Arkansas.
The applicant (Sharron Eldred Smith) is stated to be applying for a permit to:
. . .conduct regulated activities in jurisdictional areas for the construction of an earthen dam with the water control principal spillway and emergency spillway. The applicant’s stated purpose is to construct a large lake that would serve as erosion control and recreation with impounded water for game and non-game species.
The Corps public notice states that 33,500 cubic yards of clay present on-site would be used for the construction of the dam. Further, approximately 190 linear feet of an intermittent stream and 165 linear feet of an ephemeral stream would be filled. Approximately 3,268 linear feet of an ephemeral stream and 1,468 linear feet of an intermittent stream would be flooded.
The public notice states that the applicant proposes to mitigate for the unavoidable loss of stream impacts through performing permittee-responsible mitigation in the same 8-digit HUC unit 08040103.
