On December 19, 2014, the U.S. International Trade Commission ("Commission") issued a press release announcing their vote to institute an investigation of Certain Snowmobiles with Engines Having Exhaust Temperature-Controlled Engine Technology and Components Thereof (Inv. No. 337-TA-940).
The investigation is based on a November 7, 2014 complaint and December 12, 2014 amended complaint filed by Arctic Cat Inc. of Plymouth, Minnesota alleging violation of Section 337 in the importation into the U.S. and sale of certain snowmobiles with engines having exhaust temperature-controlled engine technology and components thereof that infringe one or more claims of U.S. Patent Nos. 6,371,082; 6,550,450; and 7,258,107. According to the Notice of Investigation, the Commission has identified Bombardier Recreational Products, Inc. of Canada and BRP US Inc. of Sturtevant, Wisconsin as the respondents in this matter.
Lastly, Chief ALJ Bullock issued a notice indicating that he will be the presiding Administrative Law Judge in this matter.
