The Ministry of Economic Affairs indicated in an appellate decision (Ref. No. 10306102770) that when TIPO has doubt on the authenticity of the Internet information submitted by an invalidation petitioner as evidence, such as failure to link to the corresponding webpage via the website provided by the invalidation petitioner, TIPO should not deem such Internet information inadmissible without further inquiry, and must notify the invalidation petitioner to submit supplemental evidence pursuant to the Patent Examination Guidelines, which provides that “[w]hen the evidence submitted by a party is the Internet information, attention to the reliability of website is needed…If the content or the published time of the Internet information is in doubt, or the other party contests the authenticity of the evidence, TIPO shall investigate further or notify the party to submit supplemental evidence”, so as to fulfill its responsibilities in investigating and reviewing evidence and reduce the defect in the proceeding.
