On 20 August 2009, the Competition Commission (CC) published its final report which cleared the completed acquisition by Holland & Barrett (owned by NBTY Europe) of Julian Graves Limited (JGL). HB is the UK's leading specialist retailer of health products with a network of 500 outlets while JGL is a large independent specialist in food and ingredients with over 350 stores. The CC found that the companies were close competitors for the sale of nuts, seeds and dried fruit. However, upon closer examination of the market, the CC found that when it came to purchases of these products, the parties competed with supermarket stores and other retailers. Consumers could find a sufficiently large range of these products at similar prices from these sources; meaning that the deal was unlikely to result in the substantial lessening of competition either at the national or local level within the UK.
