Claimant, aged 80, attended Defendant A&E department following a tripping accident in which she struck her chin on the ground. Claimant’s wounds were cleaned and closed but no x-rays were taken nor any referral made to maxillofacial team or follow-up arranged. Five weeks later, Claimant attended her dentist as she became aware that her teeth did not feel normal. X-ray revealed displaced fracture of condyles on both sides of jaw. Claimant suffered functional and social embarrassment, experiencing clicking and grinding of the jaw and therefore limited to soft diet, as her teeth did not meet. She was considering undergoing further dental treatment to improve tooth contact.  

Out of court settlement: £10,000 (estimated General Damages £5,000).
