As mentioned in last week’s article, a new law has recently been passed that affects the completion of Form I-9, Employment Eligibility Verification for employees who present Puerto Rican birth certificates. Birth certificates issued before July 1, 2010 will no longer be valid. The new law will only affect new hires after October 1, 2010. In such a case an employer cannot accept a Puerto Rican birth certificate issued before July 1, 2010 as one of the documents in List C. Employers do not have to re-verify employees who previously presented a Puerto Rican birth certificate issued before July 1, 2010.
