Closure of Long Term Care Facilities: Interim Final Rule

Interim final regulations published in the February 18, 2011 Federal Register implementing Section 6113 to ensure that, among other things, in the case of a LTC facility closure, administrators of a SNF or NF provide written notification of the impending closure and a plan for the relocation of residents at least 60 days prior to the impending closure.

Payment Adjustment For Health Care-Acquired Conditions: Proposed Regulations

On February 17, 2011, CMS issued proposed regulations in the Federal Register to implement section 2702 which directs the Secretary of HHS to issue Medicaid regulations effective as of July 1, 2011 prohibiting Federal payments to States for any amounts expended for providing medical assistance for health care-acquired conditions. IRS Notice 2011-02 providing guidance on the application of section 162(m)(6) of the Internal Revenue Code, added by Section 9014 of the Affordable Care Act, limiting the allowable deduction for remuneration for services provided by individuals to certain health insurance providers.
