• The DOL has recently improved its PERM Labor Certification Application processing timelines. This means that if a PERM application is selected for an audit, the affected employer receives audit notification sooner than before. To effectively combat an audit, the employer should thoroughly audit its PERM file both prior to and after the PERM application filing, and maintain documentation for possible audit. Importantly, the DOL is consistently increasing its debarment and/or revocation proceedings with regard to employers that fail to timely respond to an audit notice or submit incomplete responses.
