Employment related settlement

On 9 June 2011, UKBA launched a formal consultation on employment related settlement, tier 5 and overseas domestic workers. This consultation will close on 9 September 2011, after which UKBA will publish the results of the responses received (normally within four weeks of the closing date). If UKBA deems that the consultation responses support changes to the current rules, the changes can be expected to follow shortly.

It is important to note that the proposed changes on employment related settlement will retrospectively affect those who have entered the UK since April 2011. The key proposals can be found by clicking here. The official consultation documents can be found by clicking here.

Family related migration

On 13 July 2011, UKBA launched another proposal to reform the route to settlement; this time concerning family related migration. The proposals are far reaching and extend to dependants of temporary migrants. This consultation will close on 6 October 2011. UKBA claims that the family consultation will prevent and tackle abuse, promote integration and reduce the burdens on the taxpayer. We are working with ILPA to ensure a robust response is submitted.

We would encourage those interested in either/both of the consultations to submit their own responses to UKBA ahead of the deadlines. However, as UKBA’s template to respond to the consultations consists of closed questions, we would encourage readers to provide their own views and not to be restricted by following the official template.
