Early this month, the D.C. Circuit rejected a request from Verizon Communications Inc. to have the same panel that decided Comcast Corp. v. FCC rule on Verizon's challenge to the FCC's net neutrality rules. Notably, the rejection (which offered no explanation) came from the Comcast panel itself. Meanwhile, the FCC has asked the D.C. Circuit to reject Verizon's appeal as untimely, arguing that the appeal cannot be filed until the net neutrality order is published in the Federal Register. The court has not yet ruled on the Commission's motion.
