Employers in England and Wales should be aware of this Act which creates a new criminal offence of stirring up hatred against a person on the grounds of their religion, punishable by a fine or a prison sentence of up to seven years.

The offence applies to the use of words or behaviour, the display, publication and distribution of written materials, visual images or sound recordings, which are threatening and intended to stir up religious hatred.

Employers and employees should be aware that an act of religious discrimination in the workplace could (in appropriate circumstances) also amount to an offence under the Act.
