Casual terms in modern awards will be reviewed by the Fair Work Commission (FWC), following the passage of the Fair Work Amendment (Supporting Australia’s Jobs and Economic Recovery) Act 2021 (Amending Act) which introduced a definition of “casual employee” and casual conversion rights into the Fair Work Act 2009 (Cth).

The Amending Act requires the FWC to review relevant terms in modern awards on the basis of their interaction with the new casual employment provisions. Where there is an inconsistency, difficulty or uncertainty, the FWC must vary the modern award. The review must be completed by 27 September 2021.
