Belgium, Luxembourg, Netherlands January 20 2010

In the event of a site closure, a restructuring or a relocation, an employer that proposes to make redundant over an uninterrupted period of 60 days a certain number of employees1 must respect the following procedure:

  • A report must be provided to the employee representatives or, in the absence thereof, the employees themselves stating the employer?s intention (not yet a decision) to proceed with a collective redundancy and containing certain required information (e.g., the reasons for the intended collective dismissal, the expected number of redundancies and the period over which they will most likely be effected, the selection criteria, etc.).
