In this case the court granted a temporary injunction to prevent publication of detailed commercial investment information about Northern Rock by the Financial Times, which they had extensively reproduced on their website. It did so on the basis that it was arguable that there was a real possibility that further publication night do harm that had not already been done. The court however refused to grant an injunction to prevent publication of shorter extracts of the information that had appeared in the Daily Telegraph five days earlier. The detailed extracts published by the Telegraph had become so widely available to the public that an injunction would be futile.
