The Swedish Competition Authority (“SCA”) requested the Stockholm Administrative Court to impose a fine of SEK 210,000 on Sveriges Television (“SVT”), the Swedish public service broadcaster. According to the SCA, SVT has violated the Public Procurement Act by awarding two contracts in relation to arranging an office party without prior announcement as required by the Act. SVT claims that one of the contracts relates to a frame agreement already subjected to tendering under the public procurement rules and the other contract is a lease agreement, which is exempted from the scope of the public procurement rules. However, the SCA considers that neither of the contracts could have been awarded without public tendering. The value of the contracts is approximately SEK 2.7 million, which clearly exceeds the thresholds for requiring a prior announcement of tenders set in the Public Procurement Act.
