The Commission has issued a Statement of Objections to Alcan alleging abuse of a dominant position contrary to Article 82 EC Treaty. Alcan is the world’s largest aluminium producer and its wholly owned subsidiary, ECL, produces equipment used in aluminium smelting. The Commission’s preliminary view is that Alcan is tying its aluminium smelting technology with handling equipment sold by ECL. This prevents consumers using Alcan’s dominant smelting technology from obtaining the handling equipment from alternative sources. The Commission allege that the effect is a reduction in innovation in the market and a negative impact on aluminium prices. Alcan have the opportunity to put forward a defence to the Statement before the Commission reaches a final decision on whether competition law has been breached and whether to impose penalties.
