In a long-awaited decision, the U.S. Court of Appeals for the Third Circuit sided with the Federal Trade Commission against Wyndham Worldwide Corporation over the Commission’s authority to regulate the data security policies and practices of businesses.  The dismissive tone with which the court swept aside Wyndham’s challenge to the FTC’s authority may only embolden the Commission in its pursuit of companies whose data security it finds lacking.  It will certainly discourage companies that find themselves in the Commission’s sights after a breach from challenging the FTC’s authority.
