On September 14, 2010, CBP published in the Federal Register its modifications to the test method it currently uses to determine whether certain glassware articles constitute “pressed and toughened (specially tempered)” glassware for tariff classification purposes. The articles subject to such testing are typically imported into the United States under Harmonized Tariff Schedule of the United States (HTSUS) subheadings 7013.28.05, 7013.37.05, 7013.42.10, 7013.49.10 and 7013.99.20. CBP’s modifications include revised criteria for interpreting the results of the cutting test for opaque glassware, and set forth an interpretation of breakage for that test. CBP also reinstated the center punch test, a formerly used method of testing specially tempered glassware. The modifications provide a description of the apparatus to be used for the center punch test.
