The EEOC recently issued its Nationwide Procedures for Releasing Position Statements. These new procedures apply to all EEOC requests for position statements made to Respondents on or after January 1, 2016. Respondents can now access the Charge and submit their position statement on the EEOC’s new Digital Charge System. As we mentioned last month, the most drastic change is that the EEOC will now release Respondent’s position statement and attachments to Charging Parties upon request and provide them with an opportunity to respond. Employers should review these new procedures before submitting their position statement.
