The Government announced a consultation this month, on the asbestos related condition pleural plaques. Responses are required by 1st October 2008. Justice Minister, Bridget Prentice stated that the consultation is part of the Government’s commitment to improve understanding of pleural plaques and provide support for those who are unable to recover damages in respect of the same. The paper seeks views on a number of issues including whether it “would be appropriate” to change the law of negligence to make pleural plaques compensatable. The potential cost of overturning the House of Lords ruling (Grieves v FT Everard & Sons Ltd 2007), could be up to £28.6 billion. The MoJ however, have indicated that they are not minded to interfere with the ruling.
