The Civil Procedure Rule Committee (CPRC) recently published a consultation paper seeking views on proposals to amend Part 44 of the Civil Procedure Rules to insert rules on costs capping orders. The proposals are drawn from current case law and do not propose any new policy. However this issue is to be considered again in Lord Justice Jackson's costs review next year and it is one of the topics on which written submissions on past experience have been sought by January (see section 2 above for more details). The debate on the benefits, downsides and proper scope of costs capping is therefore set to continue.
