On May 21st, the First Circuit partially reinstated a homeowner's lawsuit against her lender for its failure to permanently modify the terms of her mortgage as required by the terms of the trial period contract. The Court also reinstated the homeowner's unfair debt collection practices claim brought under Mass.Gen.Laws ch. 93A, which allows for treble damages and attorney's fees. The complaint sufficiently alleged economic damages as a result of defendants' alleged conduct. Young v. financial institution.
