EPA has published a notice detailing its plans to reconsider portions of the national emissions standards for hazardous air pollutants (NESHAPs) and new source performance standards (NSPS) for cement kilns. 76 Fed. Reg. 28,318 (5/17/11). The agency said it will review, among other matters, (i) a requirement for cement kilns to control emissions from open clinker storage piles, (ii) the particulate matter emissions limit for modified cement kilns, (iii) site-specific alternative compliance requirements for emissions of total hydrocarbons, and (iv) whether facilities with dry-scrubbing systems may use hydrogen chloride stack tests as an alternative to continuous emissions monitoring for the pollutant.

In the notice, EPA denied petitions for reconsideration from groups asking the agency to reconsider how the cement rules interact with the revised NSPS for commercial and industrial solid waste incinerators. EPA also denied all requests that the NESHAPs and NSPS be administratively stayed.
