The U.S. Department of State (DOS) recently released its September 2008 Visa Bulletin. In this Bulletin, the DOS again advanced the EB-2 Indian and Chinese national preference categories. These categories advance from June 2006 to August 2006. Many individuals believed that the DOS would have to make both of these categories Current in the month of September in order to use all of the immigrant visa numbers allocated to the EB-2 category. However, it appears that the DOS believes that there is still sufficient demand for EB-2 immigrant visa numbers to ensure that all the available numbers are used in fiscal year 2008 which ends on September 30, 2008. As previously stated by the DOS, the EB-3 category remains Unavailable in September because the DOS previously indicated that all of the numbers available in this category were used by the end of July 2008. However, this category should again become Available in October when the government’s next fiscal year commences. It is unknown at this time what the cut-off dates will be in the EB-3 category when the category again becomes available in October 2008.
