OFT has responded to the Law Commission’s consultation on unfair terms in consumer contracts. The response raises a number of concerns, including on:

  • unexpected restrictions to contract scope;
  • terms imposing unexpected risks on consumers;
  • complex, deferred or contingent charges exceeding efficient costs; and
  • obstructions to consumer switching.
