The Health and Safety Offences Act 2008 came into force on 16 January 2009. It introduces a new regime for sentencing, including the option of imprisonment for directors in the most serious cases, and increased upper limits on fines for breach of health and safety law. With the increased penalties available, it is likely that the actions of individual directors and senior managers will come under increased scrutiny. It is important therefore that directors ensure that:
- health and safety matters are actively discussed at board level; and
- proper procedures are put in place to ensure that health and safety measures are followed at all levels of their organisation and that any incidents are properly investigated and dealt with.
