1. KONINKLIJKE PHILIPS N.V. v. GOOGLE LLC [OPINION] (2019-1177, 01-30-2020) (PROST, NEWMAN, and MOORE)  Prost, C.J.  The Court affirmed a PTAB IPR decision finding patent claims unpatentable as obvious under 35 U.S.C. § 103.  The challenged patent was directed to a particular technology for delivering digital content for playback on a client device.  The Court held that substantial evidence supported the PTAB’s determination that the challenged patent claims would have been obvious over the cited prior art in light of the skilled artisan’s general knowledge.  In addition, the Court held that the PTAB had erred in instituting a separate ground because it had not been included in the IPR petition.
