The Ohio Department of Health (ODH) has published the 2011 maximum allowable fees for medical record copies. Pursuant to Ohio law, these fees are raised (or lowered as was the case last year), in accordance with changes to the Consumer Price Index. For 2011, the maximum fees have increased by 1.64%. The ODH fee schedule is available here and is posted on the ODH website under “Medical Record Fees.” Please note that these fees establish the maximum copying fees that may be charged in Ohio, but there are other laws that may impact permissible charges (e.g., the HITECH rule at 42 U.S.C. 17935(e) provides that charges for electronic health records may not exceed labor costs only) or whether charges may be issued at all (e.g, O.R.C. 3701.741(C) provides exceptions allowing certain entities and individuals to obtain one free copy of a medical record).
