On 3 May 2012, the CAT published three orders in relation to the disclosure of information within a confidentiality ring in the context of an appeal brought by Tesco against the OFT’s decision to fine Tesco for its infringement of the Chapter I prohibition in relation to the retail pricing of cheese. One order established a confidentiality ring and set out the arrangements for the disclosure of un-redacted confidential documents to specified advisers of the other party. Another order extended the scope of the confidentiality ring to cover certain specified confidential information in the OFT’ possession relating to Asda, Arla, Dairy Crest, Glambia and McLelland.
