On 20 September 2011, the General Court annulled a decision of the European Investment Bank (“EIB”) to award a contract to a tenderer after the EIB failed to notify another tenderer of its decision. The General Court held that the EIB had failed; to advise the unsuccessful tenderer of the contract award decision, to provide reasons for its decision and to provide the unsuccessful tenderer with an effective remedy, thereby breaching transparency and equal treatment principles.
