From 1 May 2013, changes to the law introduced by the Private Rented Housing (Scotland) Act 2011 will require landlords who enter into a new assured or short assured tenancy to provide their tenants with a tenant information pack. The legislation also encompasses cases where the landlord and the tenant draw up a new lease to renew an existing tenancy.
The tenant information pack is a standardised document, which provides information to tenants on their tenancy agreement, the condition of their property, and the rights and responsibilities of landlords and tenants. The aim of the scheme is to ensure that tenants can easily access important information regarding their tenancy.
Landlords who are to provide these packs must ensure that they are in the form set out on the Scottish Government website, although landlords can also choose to provide the tenant with extra information if they wish. Failure to provide a tenant information pack is a criminal offence, with fines of up to £500 for landlords who don't comply.
