In addition to the changes made to the Civil Code, certain amendments have been introduced to Federal Law No. 98-FZ “On commercial secrecy” dated 29 July 2004.
The law now contains an exhaustive list of rights which belong to the owner of the information constituting commercial secrecy.
Certain new provisions regarding the protection of information constituting commercial secrecy within the labour relationships have been added. In accordance with these amendments, a former employee is, inter alia, obliged not to disclose the employer’s commercially secret information during the entire effective period of commercial secrecy. Furthermore, the employer is able to claim compensation for damages caused by the former employee disclosing commercially sensitive information during the effective period of commercial secrecy.
