The Secretary of State has now published the decision regarding British Sky Broadcasting’s (BSkyB) acquisition of a 17.9 per cent share in ITV. The Secretary of State had issued a public interest intervention notice under the Enterprise Act 2002 and referred the case to the Competition Commission (CC). On 14 December 2007, the CC published its findings in its investigation. In the decision published on 29 January 2008, the Secretary of State, accepting the CC’s recommendations, concluded that BSkyB’s acquisition of the 17.9 per cent stake in ITV results in a substantial lessening of competition in the “all-TV” market. BSkyB is ordered to divest its stake in ITV to a level below 7.5 per cent.
