The Department for Business, Innovation and Skills has announced that the right to request time off for training will not be extended to employees of businesses with less than 250 employees.

As of April 2010, employees of businesses with over 250 employees were given the right to request time off for training and it had been anticipated that this right would be extended to all employees as of April this year. The Government has indicated that this extension is delayed for further evaluation and may be granted at a later date following further consultation

Employers of large workforces should be aware that failing to consider such requests could result in a maximum penalty of 8 weeks’ pay at the statutory cap of £400 per week
