Treasury has published an Order amending the Order that introduced a new category of investment – alternative finance investment bonds (AFIBs) – into the Regulated Activities Order last year. It has discovered the original Order unintentionally removed some instruments from the traditional Article 77 definition of “instruments acknowledging indebtedness” if they fell within the AFIBs definition, and this created uncertainty and problems under other legislation. The new amendments make it clear Article 77 should be considered first, with the AFIBs category (Article 77A) being a residual category. The changes take effect from 16 February. (Source: 2011 No 133)
