Much of the detail of the Living Longer Living Better (LLLB) reforms resides in the aged care principles. A large number of the LLLB reforms commenced on 1 July 2014. Just days before on 27 June 2014, the government released the last of the aged care principles. All aged care principles are now finalised and incorporate the following material changes from the exposure draft versions:

Fees and Payments Principles 2014 (No. 2)

  • Includes a process by which a provider may apply to the Minister to vary the dates of its financial year.
  • Specifically prohibits uses of refundable deposits or accommodation bonds that are not permitted by the Act or Principles.
  • The Minister may approve a person other than a registered company auditor to audit an annual prudential compliance statement (this was previously covered in the Subsidy Principles).
  • Includes clarification as to the relevant ‘price agreement day’ applicable when a resident moves within a service.

Accountability Principles 2014

  • Comprehensive Financial Report provisions have been included which set out the different reporting requirements for State-owned and private aged care providers.

Subsidy Principles 2014

  • The Dementia and severe behaviours supplement now expires on 1 November 2014.
  • The Payroll tax supplement now expires on 1 April 2015.

Quality of Care Principles 2014

  • No material changes have been made from the exposure draft.

Aged Care (Transitional Provisions) Principles 2014

  • No exposure draft was released.
