Last Friday the DOJ announced an $8.5 million settlement of possible Stark Law, Anti-Kickback, and False Claims Act violations voluntarily disclosed by Memorial Hospital in Fremont, Ohio.

In 2012 Memorial (now known as Promedica Memorial) Hospital’s own internal audit revealed two financial relationships with physicians that may have violated Stark and the Anti-Kickback Statute. That August the hospital sent letters to the U.S. Attorney and the OIG disclosing the two relationships:  paying a surgeon above-market rates for the intraocular lenses he implanted, and operation of a pain management joint venture with a physician that resulted in “improper remuneration” to the physician.

Ohio will receive $600,000 of the settlement, and the balance will go to the federal government.
