The Arkansas Department of Environmental Quality (“ADEQ”) and Jacquelyn Nwanodi (“Baker”) entered into a March 28th Consent Administrative Order (“CAO”) addressing an alleged Clean Water Act National Pollution Discharge Elimination System (“NPDES”) violation. See LIS No. 17-021.
The CAO addresses an apartment complex in Little Rock, Arkansas denominated Baker Apartments.
The apartments are stated to discharge treated wastewater to Panther Branch which eventually discharges into Fourche Creek and subsequently the Arkansas River.
Baker is stated to have been issued an NPDES permit which expired on July 31, 2016. A renewal application was allegedly not provided to ADEQ by the required date for the apartments to continue discharging wastewater.
ADEQ subsequently received a renewal application on July 19, 2016 and on August 2, 2016 the renewal application was deemed administratively complete.
The CAO alleges that Baker violated Part III, Section D, Item 10 of the NPDES permit by failing to submit the renewal application by February 2, 2016. Such alleged failure of renewal is stated to constitute a violation of Ark. Code Ann. § 8-4-117(a)(3). The apartments currently hold a renewed permit which was effective on January 1, 2017.
The CAO assesses a civil penalty of $500.
