The Supreme Court has granted Prudential permission to appeal the Court of Appeal’s ruling that legal professional privilege (LPP) does not apply to any professionals other than qualified lawyers1.

Prudential had sought to extend the existing rule of LPP - which gives certain communications between a lawyer and their client confidentiality so that they cannot be disclosed to the court or third parties without the client’s consent - to advice on tax law given by accountants.  

The Law Society has confirmed that it intends to intervene in the appeal to ensure that the scope of LPP remains clear and certain.
