There were no precedential patent decisions from the Federal Circuit this week but we saw the Circuit refuse to vacate a district court order to Fujitsu to produce privileged documents to Tellabs in a patent case involving optical transport technology. In ruling on a petition for mandamus, the Circuit also found that the Eastern District of Texas had abused its discretion in denying a stay of patent litigation in favor of a previously-filed action in California district court. The cases involve the assertion of patents to smartphones owned by Rockstar, a patent holding group, against Google and suppliers of devices using its Android software.

Teva Pharmaceuticals v. Sandoz will be argued next week in the Supreme Court, a decision that will tell us if the Federal Circuit should continue its de novo review of claim construction rulings, change to a more deferential standard, or choose some sort of hybrid.
