A hair product distributor has reportedly settled for $1.2 million an enforcement action brought by the California Attorney General’s (AG’s) office. California v. Pro’s Choice Beauty Care, Inc., No. 623625 (Cal. Super. Ct. 03/16/10). The enforcement action was brought under the California Air Resources Board’s consumer product regulations that set strict limits for volatile organic compounds (VOCs) in consumer products. The settlement agreement also requires Rite Aid, Long’s Drug Stores, CVS Pharmacy, Walgreen Co., Ralph’s Grocery Co., K-Mart, and Target to remove noncompliant products from their stores in the state. The defendant must also take steps to prevent the sale of non-compliant products in California. The products covered by the settlement include (i) Redken Fabricate®, (ii) Sebastian Threads Microbe Cream®, (iii) Sebastian Shaper Plus®, (iv) John Paul Mitchell Freeze®, (v) Shine Sugar Spray Firm Hold®, (vi) Big Sexy Hair Dense®, and (vii) Short Sexy Hair Hard Up Gel®.
