The Defamation Bill 2006 passed both Houses of the Oireachtas on 9th July 2009, however it awaits signature by the President in order to be enacted.
The President has convened a meeting of the Council of State for tomorrow (Wednesday 22 July 2009) at which the constitutionality of the Defamation Bill will be discussed. The President, after consultation with the Council of State, may refer the Defamation Bill to the Supreme Court to test its constitutionality.
There has been controversy surrounding a clause in the Defamation Bill concerning the offence of blasphemous libel, which was included in order to comply with the Constitution. The Bill, as passed by the Oireachtas, contains a fine of up to €25,000 for blasphemous libel.
