The Swedish Competition Authority (“SCA”) has requested that the Stockholm District Court impose fines of over SEK 30 million on three health care providers, Aleris Diagnostik AB (“Aleris”), Capio S:t Görans Sjukhus AB (“Capio”) and Hjärtkärlgruppen Sverige AB (“Hjärtkärlgruppen”), for prohibited co-operation under a public procurement procedure for services within clinical physiology and clinical neurophysiology. The SCA found that Aleris had agreed with Capio, Globen Heart AB and Medical Support i Stockholm Aktiebolag that the parties, regardless of whom won the contract, would share the contracted tasks. Furthermore, the SCA found that the companies had participated in prohibited information exchange by revealing to each other, and agreeing upon, the tender items they would bid for. According to the SCA, such behavior is to be regarded a serious infringement of competition rules. In its application to the Stockholm District Court the SCA requested that Aleris be fined SEK 27 million, Capio SEK 1 million and Hjärtkärlgruppen SEK 2 million.
