On June 22, 2009, USCIS announced that it has met all goals to eliminate the backlog of pending FBI name checks. For future processing, USCIS has set the following standard for future name check requests:
- 98% to be completed within 30 days; and
- 2% to be completed within 90 days.
Upon completion of the FBI name check request, the information provided from the FBI may require further evaluation and additional interaction with related agencies, requiring additional delays in final adjudication.
The majority of the backlogged FBI name check requests resulted in "no record" responses, allowing a final determination of eligibility. To resume evaluation of cases pending due to previously backlogged FBI name check requests, USCIS may request beneficiaries to update fingerprint results, attend scheduled interviews, or respond to requests for additional evidence.
