Employment-Based Preference Visas

The DOS has released its Visa Bulletins outlining the availability of immigrant visa numbers for March and advance notification of visa numbers for April 2010. For March and April, employmentbased immigrant visa petitions, visa numbers remain available for all nationalities in the firstpreference category.

March 2010

The current priority dates for Indian nationals and Chinese nationals in the second-preference category are February 1, 2005 and July 8, 2005, respectively. Visa numbers remain current and available for all other nationalities in the second-preference category.

Visa numbers are available in the third-preference category as follows.

Numbers are available for all nationalities in the fourth-preference, Certain Religious Workers, fifth preference, Targeted Employment Areas/Regional Centers, and 5th Pilot Programs categories.

Diversity Immigrant Visas for March and April 2010

For March, immigrant numbers in the diversity immigrant (DV) category are available to qualified DV-2010 applicants. However, visas are only available for applicants with DV regional lottery rank numbers below the specific allocation cut-off number:

  • Africa: 29,600 (except Egypt: 18,000; Ethiopia: 16,950; Nigeria: 14,350)
  • Asia: 12,000
  • Europe: 24,700
  • North America (Bahamas): 4
  • Oceania: 880
  • South American and the Caribbean: 985

In addition, the Bulletin provided advance notification of the DV Immigrant category rank cut-offs which will apply in April. For April, visas will only be available for applicants with DV regional lottery rank numbers below the specific allocation cut-off number:

  • Africa: 31,700 (except Egypt: 20,800; Ethiopia: 19,300; Nigeria: 14,600)
  • Asia: 13,600
  • Europe: 26,300
  • North America (Bahamas): 4
  • Oceania: 1000
  • South American and the Caribbean: 1000

Advance Notification of April 2010

The advance notification of priority dates for April for Indian nationals and Chinese nationals in the second-preference category are February 1, 2005 and August 22, 2005, respectively. Visa numbers will remain current and available for all other nationalities in the second-preference category.

Visa numbers will be available in the third-preference category as follows.

Numbers will remain available for all nationalities in the fourth-preference, Certain Religious Workers, fifth preference, Targeted Employment Areas/Regional Centers, and 5th Pilot Programs categories.
