On 01 September 2011, the Organisation for Economic Co-operation and Development (“OECD”) published a report setting out the outcome of a round table discussion on the regulated conduct defence under competition law which took place in February of this year. The regulated conduct defence allows for an exemption to the general application of competition law rules and regulations where the conduct in question is mandated or dictated by regulation. The report assesses the application of the regulated conduct defence and includes thoughts on how measures can be put into place to reduce conflict between the activities of competition authorities and regulators.
