In an update to our article of 13 December 2016, proposals to introduce new protections for trade union leaders, have been held to fall foul of the Romanian Constitution and the proposals have therefore been remitted back to Parliament for review. It is now expected that the proposals will not progress and will not therefore be implemented.

In contrast, new rules regarding the representation of employees in collective negotiation processes are expected to come into force in due course. The new provisions eliminate employee representatives from the negotiation of the unit/company-level agreement where a non-representative union exists at unit/company level and the union is affiliated to a federation which is representative in the sector in which the company operates.
