By means of Decree 2245, 2012, the Ministry of Work regulated the statutory prerogative of employers in Colombia to terminate with just cause the employment agreement of an employee who is entitled to his pension. The Decree seeks to ensure that there is continuity between the time of the termination of the employment agreement and the inclusion of the employee on the payroll of pensioners of the pension regime to which he is affiliated.
The Decree emphasizes on the obligation of the Administrators of the Pension Systems to inform to the last employer of the employee, the recognition of the employee's pension and the date of inclusion in the pensioners' payroll.
In its turn, the employer must inform the Administrators of the Pension Systems the date in which the termination of the employment agreement will take place, at least with three months in advance to the date of termination of the employment agreement.
