24 June 2016 - Inquest into the death of Graeme John Jennings - On 17 April 2012, Mr Jennings was involved in a quad bike accident at his farm. He attended hospital later that evening and was subsequently admitted under the bed card of Mr Kamenjarin, consultant surgeon and appointed supervisor of surgical trainees, the following morning. During his admission, Mr Jennings was managed by the surgical team whose more junior members became aware of elevated and rising blood test results. These were not conveyed to Mr Kamenjarin because the team considered them to be consistent with a pre-existing condition alongside the trauma associated with the accident. On 20 April, Mr Kamenjarin authorised Mr Jennings discharge. Four days later, on 24 April, Mr Jennings was re-admitted to hospital suffering from severe septicaemia. In spite of active treatment, Mr Jennings condition continued to deteriorate and he died in the early hours of 26 April.
The Coroner found that Mr Kamenjarin should have 'proactively made enquiries as to what investigations had been undertaken' prior to authorising Mr Jennings discharge from his first admission. Had he done so, he would have been informed of the abnormal blood test results the significance of which he, of his own admission, would have appreciated and commenced intravenous anti-biotic management. The Coroner was convinced that this 'more likely than not' would have halted or reversed the development of the infection. The Coroner concluded that the omissions in the management of Mr Jennings during the first admission, at each level of the chain of command, were causal and/or contributing factors to his death.

Where applicant asserts he is no longer impaired. Where applicant concedes if re-registered his registration should be subject to conditions. HELD appropriate to make re-instatement order.
28 June 2016 - Health Care Complaints Commission v Elliott [2016] NSWCATOD 83 - HEALTH PRACTITIONER REGULATION NATIONAL LAW Where HCCC have lodged disciplinary proceedings with the Tribunal where personal service has not been effected on the respondent where appropriate to make an order for substituted service.
24 June 2016 - Sorbello v South Western Sydney Local Health Network; Sultan v South Western Sydney Local Health Network [2016] NSWSC 863 - Joseph suffered severe injury as the result of oxygen deprivation during his birth in 2008. He now requires lifetime care and has a significantly shortened life expectancy. Proceedings brought in negligence against the South Western Sydney Local Health Network (the Network) recently settled. In these proceedings, Joseph's parents pursue damages for nervous shock.
Prior to the hearing, the Network admitted that it owed Joseph's parents a duty of care; that it breached that duty; and that its breaches had caused some damage. The court accepted from the outset that both parents were severely shocked when they came to realise the extent of Joseph's injuries. However, the evidence established that they dealt in entirely different ways with the consequences of those injuries. The issues that remained in dispute therefore differed between the parents. So far as the mother was concerned, the issue was the nature of her psychiatric injury given the experts' competing views and the

resultant quantification of her past and future damages. In regards to the father, the issue was whether he had suffered any psychiatric injury or damage at all and if he had, its past and future quantification.
The Court found in favour of the parents. The parties agreed to calculate damages, in accordance with the Court's conclusions on how they should be assessed, once the judgment was given.

28 June 2016 - Decrease in neural tube defects since folic acid added to bread - Mandatory fortification of bread with folic acid (in Australia) and iodine (in Australia and New Zealand) was introduced in 2009 to address two important public health issues: to reduce the prevalence of neural tube defects (serious birth defects such as spina bifida) in Australia and to deal with the re-emergence of iodine deficiency in both Australia and New Zealand. The introduction of the mandatory fortification has resulted in improved health outcomes, particularly for teenagers and Aboriginal and Torres Strait Islander women, according to a new report from the AIHW.

29 June 2016 - Improved times in emergency department and long wait elective surgery - New figures released today show improved access to care for patients in the emergency department and those needing elective surgery, Minister for Health Simon Corbell has announced. The average wait time in the Canberra Hospital emergency department has improved by 14% and the average treatment time has dropped by 34 minutes over the last four months when compared with the same period last year.

Fireworks are hazardous and have the potential to cause severe burns, lacerations, bruises even visual impairment, hearing loss and broken bones. Last year 24 people across the Territory suffered firework related injuries. The majority were burns to the face and eyes, with upper limbs, trunk and lower limbs also affected.

Michael Regos
Michael is the head of the DLA Piper health litigation group.
He practises in the areas of health law, insurance law, medical negligence and coronial enquiries. He represents Victorian public hospitals and their insurers, the Victorian Managed Insurance Authority and is the solicitor of choice for Australia's second-largest private health operator.
